Terms of Service

These terms govern your use of the Mountain Memory application and related services (“the app”). By creating an account or otherwise using the app, you agree to these terms.

Mountain Memory is operated by Dennis Rohlfing, Germany. See the Imprint for full contact details and the Privacy Policy for how we handle your data.

1. Your account

You must be at least 16 years old to use Mountain Memory. You agree to provide accurate information when creating your account and to keep your sign-in credentials confidential. You are responsible for all activity that takes place under your account. One account per person.

By creating an account, you agree that Mountain Memory may use your email address to send you marketing emails about the app and related products. You may unsubscribe from such emails at any time using the unsubscribe link included in each message. Unsubscribing from marketing email does not affect operational and account-related messages, which are necessary to provide the service.

2. Your content

Mountain Memory has two layers, and ownership works differently in each.

Public route catalogue. When you create or edit a card in the shared route catalogue — including the route name, grade, length, first-ascent details, tags, area information and the card’s hero photo — you are contributing to a catalogue used by all climbers on the platform. You confirm that you have the right to contribute the content. You grant Mountain Memory a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, transferable and sublicensable licence to use, host, display, modify, adapt, translate, distribute, create derivative works from and otherwise exploit these contributions, for any purpose, including commercial products and services such as published guidebooks, derived datasets, and the training of machine-learning or other AI models. Catalogue contributions remain in the catalogue if you later delete your account; your name is removed from them. Your right to make further catalogue contributions may be suspended or revoked if you violate these terms (see § 6).

Your personal content. Everything else — including your ascents, your memory photos and captions, your personal notes, your hero-photo overrides, your profile picture, the decks you create and the partner credits you record — remains yours. You grant Mountain Memory a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for example, resize and crop) and display this content solely for the purpose of operating the service for you and for the other climbers you choose to share it with.

This licence does not extend to marketing or advertising, or to the sale or external licensing of your personal content or of models trained on it. We may train machine-learning or other AI models on your personal content only where the resulting model is used to operate or improve the service itself — for example, personalised route recommendations, fraud and abuse detection, or refining the public route catalogue — and is not licensed or otherwise made available to third parties for their own purposes. We may also derive anonymous, aggregate statistics from your personal content for the same purposes, for example computing a route’s consensus grade from logged community grade-feel data, or aggregated insights such as average grades climbed in a region.

Statistics and machine-learning models derived under this section, once derived, do not themselves identify any individual climber and are not affected by deletion of your account. The licence over your personal content otherwise ends when you delete the content or your account, except for copies that may remain in routine backups for a limited time.

3. Content involving other people

If you upload photos of, or enter the name of, another person — for example, when crediting a climbing partner — you must have the right to do so. Do not upload photos that depict identifiable people without their consent, and do not enter another person’s name in a way that misrepresents their climbing history.

The route information shown in the app — grades, lengths, first-ascent details, tags and ascent logs — is contributed by climbers using Mountain Memory and is not independently verified by us.

Climbing safety: Route grades, lengths, and ascent logs are community-contributed, not safety-verified. Mountain Memory assumes no responsibility for incorrect information. Climbing is inherently dangerous. You climb at your own risk; verify route conditions independently before climbing.

6. Moderation and removal

We may remove content, restrict an account’s ability to contribute to the shared route catalogue, or suspend or terminate an account if we reasonably believe it violates these terms or applicable law. Where practical we will explain the reason; in serious cases we may act without prior notice.

7. Service availability

Mountain Memory is provided on an “as is” and “as available” basis. The app is in active development and is currently in a beta phase: features may change, be removed, or temporarily fail. We do not guarantee uninterrupted availability or that the service will be free of errors.

8. Liability

To the extent permitted by applicable law, our liability to you is limited. Nothing in these terms excludes or limits liability that cannot be excluded by law, including liability for intent, gross negligence, injury to life, body or health caused by negligent breach of duty, breach of fundamental contractual obligations (Kardinalpflichten), or claims under the German Product Liability Act (Produkthaftungsgesetz).

For other damages caused by slight negligence in the breach of a non-fundamental duty, our liability is limited to damages that were foreseeable and typical for this type of contract.

9. Ending your use

You may stop using the app and delete your account at any time. We may terminate or suspend your access to the app if you materially violate these terms. Provisions that by their nature should survive termination — including the content licence for backups, liability, and governing law — will continue to apply.

10. Changes to these terms

We may update these terms as the app evolves. The “last updated” date at the top reflects the current version. If a change materially affects your rights, we will give reasonable notice before it takes effect. Continued use of the app after a change means you accept the updated terms.

11. Apple App Store

If you obtained the app through Apple’s App Store (including TestFlight), Apple’s Standard End User Licence Agreement also applies to your use of the app for any matters not addressed by these terms.

12. Governing law and jurisdiction

These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with habitual residence in the European Union, mandatory consumer-protection provisions of the law of your country of residence remain unaffected.
